Say not the Struggle Naught Availeth

Why does regulated capitalism in turn always tend to unfettered capitalism? Piketty has demonstrated the beginnings of the mechanism, at least when growth has fallen below the rate of return on capital.

About interestingliterature

Wealth accumulates with ever greater inequality and goes mostly to the 0. This group then uses a portion of this wealth to advertise propagandize the preferred candidates of capital and to effectively buy all major political actors. The major parties become the bought operatives of capital. Laws are made entirely to suit capital and to attack workers and ordinary people.

The masses have very little real power while they rely on voting for parties bought by capital. It becomes a political duopoly, a two-party, one-ideology system, run in cartel fashion by and for the capitalists. Economic elite domination will continue to be the form of politics while capitalism continues to be the form of economics. Relatively brief historically speaking reverse movements can occur after we have major depressions or major wars. I scarcely need add that it is hardly good that we have to hope for depressions and wars to reverse the steady concentration of capitalist wealth and power.

Only a radical departure from capitalism itself into a true socialist economy can offer any hope of a new form of politics. Unfortunately, capitalism will have to break down catastrophically for there to be any fundamental change in modern politics. This catastrophic breakdown will occur almost certainly and it will occur due to environmental collapse and climate change. Socialists need to be ready at that point to implement a socialist and eventually environmentally sustainable system in a badly ecologically damaged world and to also prevent the rise of warlord-ism and barbarism.

The elites will now work towards special forces armies backed by drones and robots. One of the intents will be to obviate the need ever again to create mass citizen armies. Lincoln, how did you like the play? Roberts, I think, is the kind of conservative who would hesitate to try. Whatever progressive legislative agenda that can actually get through anytime soon will probably be too anodyne to be at risk.

The rest of the right-wing judicial agenda would proceed apace with or without Kennedy. Long-term, being stuck with the new appointee for a few decades is another matter. According to Wikipedia, there were, as of , only two states in the US where a majority oppose equal marriage. So, even getting to the starting point of passing a new referendum or legislative restrictions that could be tested in the SC would be very difficult. And while ACA is still in some danger, the Repubs in both court and congress face the same calculation. John, the root of the current US political situation is that the GOP still gets massive traction, despite being in a minority position.

Expect Roe to be chipped away until only dust remains, despite popular support for abortion.

The same is true for marriage equality. Expect a lot more of this; Citizens United was but a foretaste. Absent an accident like Scalia which the Dems managed to bungle the Right can use timed retirements like today to maintain dominance in the Supreme Court indefinitely, as they have for 50 years. If the left takes power it was always going to need to pack the court, this just makes it obvious. Go back ten years and Obama was running against equal marriage. But I disagree with the supposition as regards religious belief exceptions on this issue.

I expect the SC to keep ducking the question as they have done so far. They can see the polling evidence the same as the Repub politicians who have given up the fight. Why would they waste political capital on something like this when they have more serious business busting unions something where Kennedy almost always went with them, AFAICT? This post is like watching Xi ban Winnie the Pooh in China and saying the free speech battle has been won. To be effective law the ordinary government as well as the lords of justice would have to defend and enforce it and as you say they are frying other fish.

But personally I am hopeful. The earth produces by itself, first the blade, then the ear, then the full grain in the ear. I think you may underestimate the development of of Arbitration Act cases on class actions, race and sex discrimination and other areas of civil rights law, and of gerrymandering. Equalization of districts for state legislatures initially depended on court decisions.

If there are no judicial remedies for gerrymandering, then it will be possible for Republicans to make their dominance more or less permanent. The last 20 years have seen very large developments in the ability of a party to tailor districts to maintain party control. I suppose with a long-enough perspective, it all will be overcome.

Similarly with a voting rights Act. The Democrats need to expand their existing majority of popular support enough to get a majority of the Congress. Senator Norris introduced a bill to simply abolish federal courts, save for the Supreme Court. Cian is right that lifetime appointment is feudal and should be swept away. We also need to fund a huge expansion of courts — the scandal of not being able to have real trials because of crowding of court dockets makes a mockery of human rights in the States and we need to discuss how to level the playing field for defendents — as it is now, the outrageous inequality in wealth is most strikingly reflecting in the general impunity of the wealthy in being either prosecuted or tried, and the general punity of the working class who are routinely routed through the prison system.

In other words, the judicial division of power in the States is thoroughly corrupt and rotten from top to bottom. It is a major contributor to racial and class inequality. Stephen 10 — I remember the events you refer to well and you could have added Earl Mountbatten and Ross McWhirter to the list. The only Fascism-related concerns that they raised in my mind had to do with possible British government responses. It would have been only too easy to use the Brighton bomb, in particular, as a pretext for a lurch to the securitarian right.

I was taking that as implicitly understood, but I should have been explicit. The Warren court was an exception. Instead it was all administrative which by definition can be unwound by the next administration in ways that were very susceptible to legal challenge. Using old legislation in new ways is always going to be subject to legal review, and probably should be albeit by a better system.

The double movement, the double crescendo of redemption in those last two stanzas, of sea and of light, is astonishingly affecting. Say not the struggle naught availeth, The labour and the wounds are vain, The enemy faints not, nor faileth, And as things have been they remain. For while the tired waves, vainly breaking, Seem here no painful inch to gain, Far back, through creeks and inlets making, Comes silent, flooding in, the main.

And not by eastern windows only, When daylight comes, comes in the light; In front the sun climbs slow, how slowly! But westward, look, the land is bright!
